Day Job Market — User Agreement & Terms of Use

1. Description of the Platform

Day Job Market is an online marketplace intended to connect individuals or businesses seeking assistance with individuals willing to perform jobs, tasks, services, chores, projects, deliveries, maintenance, cleaning, repairs, and other permitted activities.

Examples of jobs may include:

• House cleaning
• Lawn maintenance
• Snow removal
• Garbage or junk removal
• Car cleaning
• Moving assistance
• Deliveries
• Home chores
• Basic home maintenance
• Tree and yard maintenance
• Assembly
• Painting
• General labor
• Other lawful services posted by users

Day Jobs Market primarily provides the technology and marketplace through which users may find one another, communicate, post jobs, and facilitate transactions.

Day Job Market is not the employer, contractor, supervisor, or agent of individuals performing jobs.

2. Eligibility

You must satisfy all legal requirements applicable to you in your jurisdiction to use the Platform.

You agree that:

• You will provide accurate and truthful information.
• You will maintain accurate account information.
• You will not create an account using another person’s identity.
• You will not allow another person to use your account.
• You will comply with all applicable laws, regulations, licenses, permits, and requirements.
• You will not use the Platform for unlawful purposes.

If applicable law requires a user to be a certain minimum age, you represent that you satisfy that requirement.

3. Independent Users

Unless expressly stated otherwise in writing, users who perform jobs through Day Job Market are independent service providers and are responsible for determining whether they are legally classified as independent contractors, employees, self-employed persons, or another classification under applicable law.

Nothing in these Terms creates an employment relationship, partnership, joint venture, agency relationship, or franchise relationship between Day Job Market and any user.

Users are solely responsible for:

• Their work;
• Their methods of performing work;
• Their tools and equipment;
• Their transportation;
• Their taxes;
• Their licenses and permits;
• Their insurance;
• Their compliance with employment and labor laws;
• Their compliance with health and safety requirements; and
• Their actions and omissions.

Nothing in this section overrides any mandatory legal requirement that applies to the relationship between the parties.

4. User Responsibilities

Users agree to exercise reasonable care and good judgment when using the Platform.

Users must not:

• Perform illegal activities;
• Request illegal services;
• Offer illegal services;
• Intentionally damage property;
• Threaten or harass another user;
• Engage in discrimination prohibited by law;
• Misrepresent qualifications or experience;
• Misrepresent the condition or requirements of a job;
• Provide fraudulent information;
• Circumvent Platform payment systems;
• Use another person’s account;
• Attempt to access another user’s account;
• Upload malicious software;
• Abuse the messaging system;
• Use the Platform to facilitate fraud;
• Use the Platform for prohibited dangerous activities; or
• Violate applicable laws or regulations.

5. Job Descriptions and Job Safety

Individuals posting jobs are responsible for providing an accurate description of the work required.

Job posters should disclose known hazards, special equipment requirements, unusual conditions, access restrictions, dangerous materials, animals, heights, electrical systems, heavy objects, chemicals, or other circumstances that could reasonably affect the safety of a person performing the job.

Individuals accepting jobs are responsible for determining whether they are qualified, trained, physically capable, properly equipped, licensed, insured, and legally permitted to perform the work.

Users should never accept or perform a job that they believe is unsafe or beyond their qualifications.

Day Jobs Market does not guarantee that any job is safe, suitable, lawful, accurately described, or appropriate for a particular user.

6. Assumption of Risk

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EACH USER ACKNOWLEDGES THAT PARTICIPATION IN CERTAIN JOBS OR ACTIVITIES ARRANGED THROUGH THE PLATFORM MAY INVOLVE INHERENT AND UNFORESEEABLE RISKS.

SUCH RISKS MAY INCLUDE, WITHOUT LIMITATION:

• FALLS;
• SLIPS;
• TRIPS;
• CUTS;
• BURNS;
• MUSCLE STRAINS;
• BROKEN BONES;
• VEHICLE ACCIDENTS;
• PROPERTY DAMAGE;
• EXPOSURE TO WEATHER;
• EXPOSURE TO ANIMALS;
• EXPOSURE TO CHEMICALS;
• USE OF TOOLS OR EQUIPMENT;
• WORKING AT HEIGHT;
• LIFTING OR MOVING HEAVY OBJECTS;
• ELECTRICAL HAZARDS;
• CONSTRUCTION OR REPAIR HAZARDS;
• TRAFFIC HAZARDS;
• INJURY CAUSED BY THIRD PARTIES;
• PERSONAL PROPERTY LOSS; AND
• OTHER RISKS ASSOCIATED WITH PERFORMING OR RECEIVING SERVICES.

By voluntarily accepting or performing a job, the user acknowledges and assumes responsibility for evaluating and accepting the risks associated with that activity, to the extent permitted by law.

7. Release and Waiver of Liability

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BY USING THE PLATFORM OR PARTICIPATING IN A JOB ARRANGED THROUGH THE PLATFORM, YOU AGREE TO RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS DAY JOBS MARKET, ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, REPRESENTATIVES, AGENTS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, THE “RELEASED PARTIES”) FROM CLAIMS ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM OR YOUR PARTICIPATION IN A JOB.

THIS RELEASE INCLUDES, TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAIMS RELATING TO:

• PERSONAL INJURY;
• BODILY INJURY;
• ILLNESS;
• DEATH;
• PROPERTY DAMAGE;
• PROPERTY LOSS;
• MEDICAL EXPENSES;
• HOSPITAL EXPENSES;
• TRANSPORTATION EXPENSES;
• REHABILITATION EXPENSES;
• LOST WAGES OR INCOME;
• BUSINESS INTERRUPTION;
• TRAVEL EXPENSES;
• DAMAGE TO VEHICLES OR EQUIPMENT;
• CLAIMS ARISING FROM THE ACTIONS OR OMISSIONS OF OTHER USERS; AND
• OTHER COSTS OR EXPENSES RESULTING FROM PARTICIPATION IN A JOB OR USE OF THE PLATFORM.

YOU ACKNOWLEDGE THAT DAY JOBS MARKET DOES NOT CONTROL HOW USERS PERFORM JOBS AND THAT YOU VOLUNTARILY PARTICIPATE IN JOBS AT YOUR OWN RISK.

YOU FURTHER ACKNOWLEDGE THAT DAY JOBS MARKET DOES NOT PROVIDE MEDICAL, SAFETY, PROFESSIONAL, LEGAL, OR INSURANCE SERVICES TO USERS.

Nothing in these Terms is intended to waive rights or liabilities that cannot legally be waived under applicable law.

8. Injuries and Medical Expenses

Each user is responsible for obtaining and maintaining whatever health, accident, disability, automobile, homeowner, renter, commercial, workers’ compensation, or other insurance the user believes is appropriate or is legally required to maintain.

Day Job Market does not promise to provide insurance coverage for users or for injuries, accidents, losses, or expenses arising from jobs performed through the Platform unless expressly stated in a separate written insurance agreement.

If you are injured while performing or receiving a service, you are responsible for obtaining appropriate medical attention and for your own medical expenses, except to the extent that applicable law provides otherwise or another party is legally responsible.

9. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Day Job Market and its owners, officers, directors, employees, contractors, affiliates, agents, successors, and assigns from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising out of or relating to:

• Your use of the Platform;
• Your violation of these Terms;
• Your violation of applicable law;
• Your conduct toward another user;
• Your performance or acceptance of a job;
• Damage caused by you to property or persons;
• Your negligence or misconduct;
• Information you provide through the Platform;
• A dispute between you and another user; or
• Your breach of any representation or warranty contained in these Terms.

This obligation does not apply to the extent prohibited by applicable law.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAY JOBS MARKET AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:

• USE OF THE PLATFORM;
• INABILITY TO USE THE PLATFORM;
• A JOB POSTED THROUGH THE PLATFORM;
• SERVICES PROVIDED BY ANOTHER USER;
• ACTIONS OR OMISSIONS OF ANOTHER USER;
• PERSONAL INJURY;
• PROPERTY DAMAGE;
• LOSS OF PROPERTY;
• LOSS OF PROFITS;
• LOSS OF INCOME;
• MEDICAL EXPENSES; OR
• OTHER LOSSES OR EXPENSES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAY JOBS MARKET’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT OF PLATFORM FEES ACTUALLY PAID BY YOU TO DAY JOBS MARKET DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR

(B) $100.00.

This limitation does not apply where prohibited by applicable law.

11. No Guarantee of Users or Services

Day Job Market does not guarantee:

• The identity of any user;
• The qualifications of any user;
• The background of any user;
• The quality of work performed;
• The safety of any job;
• The legality of a job;
• The accuracy of job descriptions;
• The availability of users;
• The completion of a job;
• The payment of a user;
• The conduct of a user;
• The condition of a property;
• The suitability of a user for a particular job; or
• The accuracy of information supplied by users.

Users are responsible for conducting whatever verification or due diligence they consider appropriate.

12. Background Checks

Unless expressly stated otherwise, Day Job Market does not represent that users have undergone criminal background checks, employment verification, professional licensing verification, identity verification, driving-record checks, or other screening.

If Day Job Market offers screening or verification services, such services do not constitute a guarantee of a user’s identity, safety, qualifications, or conduct.

13. Payments and Platform Fees

Day Job Market may charge fees or commissions for transactions conducted through the Platform.

Any applicable fees will be disclosed through the Platform or applicable payment terms.

Users authorize Day Job Market and its payment-processing providers to process payments according to the applicable transaction terms.

Day Job Market may modify its fees from time to time, subject to applicable law and appropriate notice.

14. Cancellations and Disputes

Day Job Market may establish cancellation, refund, dispute-resolution, or payment policies.

Users agree to communicate honestly and in good faith regarding disputes.

Day Job Market may investigate disputes but does not guarantee that it will resolve disputes in favor of either party.

To the extent permitted by law, Day Job Market is not responsible for losses resulting from disputes between users.

15. Property Damage

Users performing jobs are responsible for exercising reasonable care to avoid damage to property.

Users should disclose known property conditions or hazards before work begins.

Day Job Market is not responsible for property damage caused by users or third parties, except to the extent that applicable law provides otherwise.

16. Prohibited Activities

The Platform may not be used to arrange or facilitate unlawful or inherently dangerous activities, including activities prohibited by Day Job Market.

Day Job Market may remove job postings, suspend accounts, cancel transactions, or terminate accounts when it reasonably believes that a user or job violates these Terms or creates a safety, legal, or security concern.

17. User Content

Users may submit job descriptions, photographs, messages, reviews, ratings, comments, and other information (“User Content”).

You retain ownership of your User Content, subject to the rights granted to Day Job Market under these Terms.

By submitting User Content, you grant Day Job Market a non-exclusive, worldwide, royalty-free license to host, display, reproduce, transmit, format, and otherwise use the User Content as reasonably necessary to operate, improve, market, and provide the Platform.

You represent that you have the right to submit the User Content and that it does not violate another person’s rights or applicable law.

18. Reviews and Ratings

Users may be permitted to provide reviews and ratings of other users.

Reviews must be honest and based on actual experiences.

Users may not:

• Submit fake reviews;
• Submit reviews on behalf of another person;
• Manipulate ratings;
• Threaten another user to obtain a favorable review;
• Post knowingly false information; or
• Use reviews to harass or discriminate against another person.

Day Job Market may remove reviews that violate these Terms or applicable law.

19. Privacy

Use of the Platform is also subject to the Day Job Market Privacy Policy.

Users acknowledge that certain information may need to be shared with other users to facilitate jobs and transactions.

Users agree not to misuse personal information obtained through the Platform.

20. Electronic Communications

By creating an account, you consent to receiving electronic communications from Day Job Market concerning:

• Your account;
• Transactions;
• Job postings;
• Payments;
• Security;
• Platform updates;
• Policy changes; and
• Other matters relating to the Platform.

You may be able to manage certain promotional communications through your account settings.

21. Account Suspension and Termination

Day Job Market may suspend, restrict, or terminate an account if it believes that the user:

• Violated these Terms;
• Engaged in fraudulent conduct;
• Created a safety risk;
• Violated applicable law;
• Provided false information;
• Abused another user;
• Attempted to circumvent Platform fees;
• Misused the Platform; or
• Otherwise created a risk to the Platform or its users.

Termination does not eliminate obligations that accrued before termination.

22. Third-Party Services

The Platform may rely upon third-party providers for services such as:

• Payment processing;
• Mapping;
• Communications;
• Identity verification;
• Hosting;
• Analytics;
• Advertising; and
• Other technology services.

Day Job Market is not responsible for the acts or omissions of independent third-party providers to the maximum extent permitted by law.

23. Maps and Location Information

The Platform may use mapping and location services to assist users in identifying job locations.

Location information may not always be exact or current.

Users are responsible for verifying the actual location, access conditions, and suitability of a job before beginning work.

24. No Professional Advice

Information provided through Day Job Market is for general informational purposes only.

Day Job Market does not provide legal, medical, financial, tax, construction, electrical, plumbing, engineering, or other professional advice.

Users are responsible for obtaining appropriate professional advice when necessary.

25. Emergency Situations

Users should contact appropriate emergency services when an emergency, serious injury, fire, crime, or other immediate danger occurs.

Day Job Market is not an emergency-response service.

26. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

DAY JOB MARKET DISCLAIMS WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, SECURITY, ACCURACY, OR RELIABILITY.

DAY JOB MARKET DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS.

27. Dispute Resolution

Before initiating formal legal proceedings, users agree to make a reasonable attempt to resolve disputes directly with Day Job Market.

Where legally permitted, Day Job Market may require disputes to be resolved through binding arbitration rather than court proceedings.

Any arbitration provision should be reviewed and customized by qualified legal counsel to comply with the laws applicable to Day Job Market and its users.

28. Governing Law

These Terms shall be governed by the laws of the jurisdiction designated by Day Job Market, without regard to conflict-of-law principles, except where applicable law requires otherwise.

The parties agree that any legally permitted court proceedings shall occur in the applicable jurisdiction designated by Day Job Market.

29. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

30. Changes to These Terms

Day Job Market may modify these Terms from time to time.

Updated Terms may be posted on the Platform with a revised effective date.

Your continued use of the Platform after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

31. Entire Agreement

These Terms, together with any applicable policies, payment terms, privacy policy, and other agreements expressly incorporated by reference, constitute the agreement between you and Day Job Market regarding your use of the Platform.

32. Acknowledgement and Electronic Acceptance

By selecting “I Agree,” “Create Account,” “Sign Up,” “Accept,” or another similar button or checkbox, or by otherwise using the Platform after being presented with these Terms, you acknowledge that:

• You have read these Terms;
• You understand these Terms;
• You agree to be bound by these Terms;
• You understand that jobs arranged through the Platform may involve risks;
• You accept responsibility for determining whether a job is safe and appropriate for you;
• You understand that Day Job Market is generally a marketplace and does not control how users perform jobs;
• You understand the liability limitations and release provisions contained in these Terms;
• You understand that you are responsible for your own insurance and expenses to the extent permitted by law; and
• You agree to comply with all applicable laws and regulations.

33. User Agreement Acceptance

BY CLICKING “I AGREE,” YOU ELECTRONICALLY SIGN THIS AGREEMENT AND AGREE THAT YOUR ELECTRONIC ACCEPTANCE HAS THE SAME INTENT AND EFFECT AS A HANDWRITTEN SIGNATURE, TO THE EXTENT PERMITTED BY LAW. EFFECTIVE SEPTEMBER 10, 2026.
